Technologies and services created by MVX-World help individuals connect with one another, create communities, and expand their enterprises. Except where we specifically specify that different terms (and not these) apply, these Terms govern your use of Megaton International Ltd, and all other features, apps, services, technologies, and software we provide [the MVX-World Products or Products]. You are receiving these Products from Megaton International Ltd.

Unless otherwise specified, there are VISA access fees of which VISA FREE is free for life associated with using MVX or the other goods and services covered by these Terms. Companies, groups, and other people pay to display advertisements for their goods and services to you.

By using our products, you consent to us displaying advertisements to you that we believe may be pertinent to you and your interests. Your personal information is used to help us choose which tailored advertising to provide to you.

We don't sell your personal information to marketers, and unless you specifically consent, we won't disclose details that can be used to identify you (such your name, email address, or other contact information) with third parties for their marketing purposes. Instead, we show the advertising to people who might be interested after receiving information from the marketers about the audience they want to see their ads.

To better understand how people are engaging with their content, we give marketers reports on the effectiveness of their adverts. For additional information regarding tailored advertising under these terms on the MVX-World Products, see Section 2 below.

Our Privacy Policy outlines how we gather and utilize your personal information to deliver all the various services listed below as well as choose some of the advertisements you see.

Every aspect of your experience on MVX World is unique to you, including the MVX World Pages you follow, the MVX World Online Store, CityBook and other platforms. You may also see posts, stories, events, ads, and other types of content on MVX World News Feed or on the video platform. For instance, we utilize information about the connections you establish, the settings and options you choose, and the actions you take both on and off our Products to tailor your experience.

Join you with the people and groups you care about:

Throughout the MVX-World Products you use, we assist you in locating and connecting with the people, groups, companies, organizations, and others that matter to you. We use data to propose things to you and other people, like groups to join, gatherings to go to, MVX worldwide Pages to follow or message, programs to watch, and acquaintances you might like to create. Better communities are built on stronger links, and we think our services are most helpful when people are connected to the groups, individuals, and organizations they care about.

Give you the tools you need to communicate what matters to you and to express yourself:

On Megaton International, you can express yourself in a variety of ways to talk to people about the things that are important to you. For instance, you can share status updates, pictures, videos, and stories across the MVX-World Products in accordance with your privacy settings. You can also send messages or make voice or video calls to one or more people. You can also create events or groups. You can also add content to your profile. To create and distribute more expressive and interesting material for MVX-World Products, we have also invented and are still exploring new ways for people to use technology, such as augmented reality and 360-degree video.

Assisting you in finding materials, goods, and services that may be of interest to you

To assist you in learning about the material, goods, and services provided by the numerous companies and organizations that make use of Megaton International and other MVX-World Products, we present you with personalized adverts, offers, and other sponsored or commercial content. This is explained in more depth in Section 2 below.

Promote the integrity, security, and safety of our services, stop harmful behaviour, and protect our user community:

Only when users feel comfortable and secure on MVX-World will they begin to form communities. We make a lot of effort to keep our products and services secure, including their availability, validity, integrity, and confidentiality. We work with external service providers, partners, and other pertinent entities, employ devoted teams around the world, and develop cutting-edge technical systems to identify potential product misuse, harmful behaviour toward others, and circumstances where we may be able to support or protect our community, including in response to user reports of potentially objectionable content. Depending on our assessment, if we become aware of such content or activity, we may decide to take the following actions: alerting you, aiding, removing the offending material or conduct, limiting or restricting access to services, deactivating an account, or getting in touch with law enforcement. To keep MVX-World Products, users, and the community safe, we share data among MVX-World Companies when we notice abuse or harmful behaviour by someone using one of our products. To help MVX-World Companies that offer financial products and services maintain safety, security, and integrity and comply with applicable law, for instance, we share information with them. If MVX-World has a good faith conviction that doing so is required or permitted by law, then it may access, store, utilize, and distribute any information it gathers about you. Utilize and create cutting-edge technologies to offer everyone secure and useful services:

We utilize and create cutting-edge technologies, like artificial intelligence, machine learning, virtual reality, extended reality, mixed reality and augmented reality, to enable anyone, anywhere to use our products safely. For instance, such technology aids those with visual impairments in comprehending what or who is depicted in images or videos published on Megaton International or Instagram. Additionally, we develop sophisticated network and communication technology to enable more users to access the internet in remote locations. Additionally, we create automated technologies to enhance our capacity to identify and stop harmful and abusive behaviour that could endanger our community and the integrity of our products.

Look at methods to improve our services:

To create, test, and enhance our products, we do research. By conducting surveys, testing new features, and fixing issues that arise, for instance, we may analyze the information we have about our users and better understand how they use our products. In order to develop and enhance our services, we use the information collected to assist this study in accordance with our Privacy Policy.

Across all MVX-World Company Products, deliver unified and seamless experiences:

Our products make it easier for you to locate and communicate with SPOI’s [special points of interest] POI’s [Points of Interest] the people, teams, companies, groups, and other entities that are significant to you. We build our systems to ensure that your interactions with the various MVX-World products you use are seamless and consistent.

Ensuring that our services are accessible:

We must transport, store, and distribute content and data to our data centres, partners, service providers, vendors, and systems around the world, including outside of your country of residence, to run our worldwide services and let you connect with people around the world. To deliver our services, the utilization of this worldwide infrastructure is crucial and necessary.

How are your services paid for?

The VISA access products carry a cost excepting for VISA FREE and by using the Megaton international products covered by these Terms, you consent to our right to show you advertisements that companies and organizations pay us to promote on and off the Megaton international Company products,. To offer you advertisements that are more relevant to you, we use your personal data, such as details about your activities and interests.

We've placed a priority on protecting people's privacy when designing our ad system. This entails that we can present you with relevant and helpful adverts without disclosing your identity to the advertisers. We do not sell your private information. We give advertisers the opportunity to communicate with us about topics like their company objectives and the target market for their adverts.

To help advertisers, understand how people are engaging with their content on and off Megaton international, we also give them reports on the effectiveness of their adverts. To assist marketers better understand their audience, we, for instance, give them with generic demographic and interest information Unless you specifically consent, we won't reveal any information about you that can be used to contact you or otherwise directly identify you, such as your name or email address. To offer you the services outlined above, we gather and use your personal information. In our Data Policy, you may find information on how we gather and use your data. You have control over the kinds of advertisements and advertisers you see, as well as the kinds of data we use to choose which advertisements to display to you.

3.    Use the same name on your account as you do in daily life.

4.    Provide proper self-description information.

5.    Only set up one account (your own) and use it for private matters.

6.    Do not transfer your account to another person, divulge your password, or let anybody else access to your Megaton international account. (without our permission).

7.    We work to ensure that MVX is widely accessible to everyone, however you are unable to use it if:

·         You are under the age of thirteen.

·         You have a history of sexual offenses.

·         For prior violations of our Terms, the Community Standards, or other terms and policies that govern your use of Megaton international, we have previously disabled your account. You agree not to open another account without our consent if we disable your account due to a breach of our Terms, the Community Standards, or any other terms and rules. Permission to open a new account is granted at our sole discretion and in no way implies that the disciplinary action taken against you was unfair or without cause.

·         The applicable laws forbid you from getting our goods, services, or software.

·         What is permitted on the MVX-World Products

·         We want people to use MVX-World Products to express themselves and to share information that is meaningful to them, but we don't want this to come at the price of other people's safety and well-being or our community's integrity. As a result, you consent to refrain from engaging in the following behaviour (or helping or encouraging others to do so):

                                         i.    Use of our products for any activity or sharing is prohibited.

                                        ii.    That contravenes the Community Standards, these Terms, or any terms and conditions that govern your use of our products.

                                       iii.    This is dishonest, false, discriminatory, or deceptive. (or assists someone else in using our Products in such a way).

                                       iv.    You lack the appropriate ownership or sharing rights.

                                        v.    That violates or infringes the rights of another party, including their intellectual property rights (by, for example, violating their copyright or trademark, or by disseminating or selling pirated or counterfeit goods), unless a legal exception or restriction applies.

                                       vi.    You are not allowed to send spam, upload viruses or other malicious software, or take any other actions that would obstruct our services, systems, or products' ability to function properly or to maintain their integrity.

                                      vii.    Without getting our permission beforehand, you are not allowed to use automated methods to access, gather, or attempt to obtain data from our products that you do not have authorization to access.

                                    viii.    You are not permitted to misuse access tokens, proxy, request, or collect usernames or passwords for product accounts.

                                       ix.    Except as stated in the Platform Terms, you are not permitted to sell, license, or buy any data that you have got from us or our services.

                                        x.    Any reporting, flagging, dispute, or appeals channel may not be abused, including through the filing of false, redundant, or baseless complaints or appeals.

                                       xi.    When content violates our rules, we have the right to remove it or restrict access to it. As stated in Section 4.B, we have the right to suspend or disable your account for behaviour that breaches these rules.

                                      xii.    Unless you seriously or repeatedly violate these Terms, expose us or others to legal liability, harm our community of users, compromise or interfere with the integrity or operation of any of our services, systems, or Products, where we are constrained by technical constraints, or where we are prohibited by law from doing so, we'll let you know if we remove content that you've shared in violation of the Community Standards and explain any options you have to request another review. See Section 4.B below for details on account suspension or cancellation.

                                    xiii.    If this option is available in your country, we invite you to report any content or behaviour you believe violates your rights (including intellectual property rights) or our terms and regulations to always support our community.

                                    xiv.    If we believe that doing so is reasonably required to prevent or mitigate the misuse of our services or negative legal or regulatory effects on MVX-World, we may also remove or restrict access to content features, services, or information.

The authorizations you grant us for us to deliver our services, we require your permission to:

• Content you create and post may be covered by intellectual property regulations if you upload or share certain types of media like images or movies.
• Any such content that you produce and share on Megaton International and other MVX-World Company products remains your property, including any copyrights or trademarks. Nothing in these Terms restricts your ability to use your own work. You are free to distribute your material wherever and with whomever you choose.
• However, for us to offer our services, we require that you grant us a "license" to use this content. This is only done to deliver and enhance the products and services mentioned in Section 1 above.
• You specifically grant us a non-exclusive, transferable, sub-licensable, worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of any intellectual property rights in any content you share, post, or upload on or in connection with our products. (consistent with your privacy and application settings). For instance, if you share a photo on Megaton International, you authorize us to store, copy, and share it with third parties, such as MVX-World products or service providers that support those products and services (again, in accordance with your settings). When your work is removed from our systems, this license expires.
• Any time you choose, you can remove a specific piece of shared, posted, or uploaded content. In addition, if you cancel your account, all posts made to your personal account will also be removed. Find out more information regarding account deletion. When you deactivate your account, the content you've posted as the administrator of a page or the content you've created in collaboration with other users—such as images in shared albums that might still be viewable to other album members—does not also get deleted.
• After we start the account deletion process or get a request to delete content, it could take up to 90 days to do so. Unless you decide to delete the item sooner, the deletion process for content sent to the trash will start automatically after 30 days. The process of removing such content is currently underway, but other users can no longer access it. We may need another 90 days to erase the content from backup and disaster recovery systems once it has been destroyed.

In the following circumstances, content won't be removed within 90 days of the start of the process for deleting an account or content:

• If someone has used your content in compliance with this license and they haven't yet taken it down, this license will still be in effect until they do;
• if, for technical reasons, deletion within 90 days is not possible, in which case we shall execute the deletion as soon as it is technically practicable; or
• in instances when quick deletion would limit our capacity to:
• investigate or find illegal conduct or violations of our terms and regulations (such as looking into or finding abuse of our systems or products);
• safeguard the integrity, security, and safety of our systems, services, personnel, and clients in order to defend ourselves;
• adhere to legal requirements for the preservation of evidence, including data that businesses that provide financial products and services must keep meeting any record-keeping requirements imposed by law; or
• abide by a request by a government agency, law enforcement, or judicial or administrative authority;
• In that situation, the content will only be kept for as long as it's required to fulfil the purposes for which it was originally stored. (the exact duration will vary on a case-by-case basis).
• In each of the scenarios, this license will remain in effect until the content is completely removed.
• You grant us permission to use your name, profile picture, and information regarding your actions in conjunction with ads, offers, and other sponsored or commercial content that we display throughout our Products without charging you any fees. This permission includes the use of your name, profile picture, and information regarding your Megaton International activity. When you like a Megaton international Page made by a company that has paid us to display its adverts on Megaton international, we may let your friends know that you are interested in an event that is being marketed. Only those with your permission to view the activities you've performed on MVX-World Products can see ads and content like this. You may find out more about your ad preferences and settings.
• Permission to download and install software updates that you use or download: By using or downloading our software, you grant us permission to download and install software updates, if any are available.
• No-use restrictions on our intellectual property.
• We retain full ownership of any intellectual property rights we have in any content that you use in our products, including any photos, graphics, videos, or sounds that you include into content you produce or publish on Megaton International. (but not yours). Only those uses of our trademarks or copyrights (or any marks that are similar to them) that are expressly authorized by our brand usage guidelines or with our prior written consent are permitted. Unless an exception or restriction applies under applicable law or your conduct relates to the MVX-World Bug Bounty Program, you must first obtain our written consent (or permission under an open-source license) before you modify, translate, create derivative works of, decompile, reverse engineer, or otherwise attempt to extract source code from us.

Additional guidelines

·         Revisions to our Terms

• To make our products better for you and our community, we constantly seek to enhance our services and provide brand-new features. As a result, we might occasionally need to alter these Terms to reflect our services and practices more accurately, to ensure that using our products and services is safe and secure, or to ensure that we are in compliance with the law. If any modifications are necessary for safety and security, to comply with applicable law, or if the provisions are no longer appropriate or incomplete, we will only make them if they are reasonable, take into consideration your interests, and are reasonable.
• Unless modifications are required by law, we will give you at least 30 days' notice (for instance, via email or through our Products) before we make any changes to these Terms, so you have time to consider them before they take effect. You will be obligated to abide by any revised Terms once they go into effect if you keep using our products.
• Although we hope you'll keep using our products, you may always deactivate your account if you decide you no longer want to be a part of the MVX-World community or don't agree with our amended Terms.

Account closure or suspension

• We want Megaton International to be a place where individuals can express themselves freely and feel safe doing so.
• You may have your access to MVX-World Company Products suspended or permanently disabled, and we may permanently disable or delete your account if we find, in our sole discretion, that you have plainly, significantly, or repeatedly violated our Terms or Policies, particularly the Community Standards. If you frequently violate someone else's intellectual property rights or if we are compelled to do so by law, we may also disable or cancel your account.
• If after registration your account is not verified, if it is dormant for an extended length of time, if we discover someone may have used it without your permission, or if we are unable to verify your ownership of the account, we may disable or delete your account. • If we take such action, we will notify you and explain your options for requesting a review, unless doing so could subject us or others to liability, harm our user community, jeopardize or interfere with the integrity or proper functioning of any of our services, systems, or Products, be prohibited by technical constraints, or be illegal.
• You may find out more about what to do if your account has been disabled and how to get in touch with us if you believe that we may have mistakenly done so.
• These Terms will come to an end as an agreement between you and us if you or we disable or delete your account, but clauses 3, 4.2, and 4.5 will still apply.

Liability restrictions

• We make a lot of effort to offer the best Products we can and to lay down precise usage instructions for everyone. To the extent permitted by law, we provide our Products "as is" and disclaim any responsibility for their continued safety, security, or error-free operation or for any interruptions, delays, or flaws in their functionality. To the fullest extent permitted by law, we also DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not control or direct what people and other third parties do or say, and we are not liable for their actions or conduct (whether online or offline), or (including offensive, inappropriate, obscene, unlawful, and other objectionable content).
• We are unable to foresee when problems with our products may occur. As a result, we will only be liable to the degree authorized by applicable legislation. In no event, and to the fullest extent permitted by applicable law, will we be liable to you for any lost profits, revenues, information, or data, or for any consequential, special, indirect, exemplary, punitive, or incidental damages arising out of or connected with these Terms or the MVX-World Products (however caused and on any theory of liability, including negligence), even if we have been informed of the possibility of such damages.

Disputes

• We try to lay forth clear guidelines so that we can limit or, ideally, prevent disagreements between you and us. But if a dispute does develop, it's helpful to be aware of the venue and rules that will govern it in advance.
• If you are a consumer, the laws of the country in which you reside will govern any claim, cause of action, or dispute you have against us that arises from or is related to these Terms or the MVX-World Products. You may resolve your claim in any competent court located in the country in which you reside. In all other circumstances, you and MVX-World concur that any claim, cause of action, or dispute that MVX-World brings against you must be handled only in the United States. San Mateo County state court or the Northern District of California district court. In addition, you acknowledge that these Terms, as well as any claim, cause of or, or disagreement arising out of or related to them, shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law. Without limiting, you agree that MVX-World may, in its sole discretion, file any claim, cause of action, or dispute it has against you in any court that has jurisdiction over the matter in the nation in which you reside.

Other

·         The complete agreement governing your use of our Products is set forth in these Terms (formerly known as the Statement of Rights and Responsibilities). They take the place of all preceding agreements.

·         Additionally, there are additional terms that apply to some of the Products we provide. Additional terms will be made available and included in our contract with you if you use any of those Products. For instance, you must accept our Commercial Terms if you access or use our products for commercial or business purposes, such as purchasing advertising, selling goods, building apps, managing a group or Page for your company, or utilizing our measurement services. You must adhere to our Music Guidelines if you post or share content that includes music. In the event of a discrepancy between any supplemental terms and these Terms, the supplemental terms shall take precedence.

·         The unenforceable section of these Terms will be severed if it cannot be rendered enforceable and the remaining portions will continue to be in full force and effect if any portion of these Terms is found to be unenforceable. We will not be deemed to have waived any of these Terms if we fail to enforce any of them. These Terms may not be modified or waived except by a writing signed by us.

·         Without our permission, you won't assign any of your obligations or rights under these Terms to anyone else.

·         If your account is memorialized, you can choose someone to handle it (this person is referred to as a legacy contact). Only your legacy contact or a person you've named in a valid will or other legal document expressing clear consent to disclose your content to that person upon death or incapacity will be able to request a limited disclosure of information from your account after it is memorialized if you enable it in your settings.

·         No rights to third-party beneficiaries are granted by these Terms. We are free to transfer all of our rights and responsibilities under these Terms in conjunction with a merger, asset purchase, asset sale, through operation of law, or in any other way.

·         In rare situations, we might alter your account's username. (for example, if someone else claims the username and it appears unrelated to the name you use in everyday life).

·         Regarding our goods and services, we always value your comments and other ideas. However, there are no restrictions on how we can use your feedback or other recommendations, and we are not required to pay you anything or keep them a secret.

·         All rights not specifically given to you are reserved by us.

·         Additional terms and conditions that could apply to your Community Standards: This section of the rules outlines our expectations for the material you submit on Megaton International and your behaviour there and on other MVX-World Products.

·         Commercial conditions:

·         If you access or use our products for any commercial or business purpose, such as advertising, running an application on our platform, using our measurement services, running a group or page for a company, or offering goods or services for sale, these conditions also apply to you.

·         MVX-World Products that are purchased on or through them are subject to the Community Payment Terms.

·         Commerce Policies: The rules that apply when you list goods or services for sale on Megaton International, Instagram, and WhatsApp are described in this section.

·         Music Guidelines: These rules describe what to do if you share or post anything that includes music on any MVX-World products.

·         Advertising Policies: These regulations govern partners who place advertisements on MVX-World Products and outline the kinds of ad content those partners may use.

·         Self-Serve Ad rules: These rules apply when you develop, submit, or deliver advertising or other commercial or sponsored activity or material using self-serve advertising interfaces.

·         Megaton international Pages, Groups, and Events Policy: If you establish or manage a Megaton international Page, group, or event, or if you use Megaton international to spread the word about or manage a promotion, you must abide by these rules.

·         MVX-World Platform Policy: These terms govern the usage of a collection of APIs, SDKs, tools, plugins, code, technologies, content, and services that let others create functionality, access data from MVX-World Products, or give us data.

Developer Payment Terms:

·         These terms apply to those who create software that integrates with Megaton global payments.

·         MVX-World Brand Resources: These policies describe how to use MVX-World's logos, images, and trademarks.

·         Recommendations Policies: Our rules for recommending and not recommending content are outlined in the Megaton worldwide Recommendations Policies and the Instagram Recommendations Policies.

·         Live Policies: All content aired to Megaton International Live is subject to these policies.

MVX-World has replaced Megaton International/MegatonCities as the brand name. On April 4, 2023, we will change our Terms of Use, Data Policy, and Cookies Policy to reflect the new name. The Megaton worldwide PWA app from MVX-World is one of the items we continue to provide.  The terms of service and our data policy are still in force, and this name change has no impact on how we use or share data.
